Procurement Law

A LAW TO ESTABLISH THE STATE BOARD ON PUBLIC PROCUREMENT AND THE BUREAU OF PUBLIC PROCUREMENT AS THE REGULATORY AUTHORITIES RESPONSIBLE FOR THE MONITORING AND OVERSIGHT OF PUBLIC PROCUREMENT AND FOR RELATED MATTERS.

Commencement  – 2017

IT WAS ENACTED by the Ondo State House of Assembly in this Legislative session convened as follows:
PART I – ESTABLISHMENT OF STATE BOARD ON PUBLIC PROCUREMENT
  1. There is hereby established the State Board on Public Procurement Establishment (in this Law referred to as “the Board”)of the State Board on.
  2. The Board shall consist of: Public Procurement
    • the Governor of Ondo State or his appointee as Chairman; and its
    • the Commissioner in charge of Budget and Planning; membership
    • the Attorney-General and Commissioner for Justice;
    • the Secretary to the State Government;
    • the Head of Service;
    • Commissioner in charge of Finance;
    • One Chairman of Local Government representing Chairmen of 18 Local Governments;
    • Seven part-time members comprising one member each representing:
      1. Chartered Institute of Purchasing and Supplies (CIPS),
      2. A certified construction-related body, Ondo State Chapter
      3. Nigerian Bar Association (NBA), Ondo State Chapter
      4. Pharmaceutical Society of Nigeria (PSN), Ondo State Chapter
      5. A certified accounting body, Ondo State Chapter
      6. All tertiary institutions in Ondo State and
      7. Recognized Civil Society Organization
    • The Director- General of the Bureau who shall be the Chief Executive Officer (CEO) and Vice Chairman of the Board,    and shall preside in the absence of the Chairman.
    • The Bureau shall have a Secretary. Such officer shall not be less than GL.15 and above.
  3. Notwithstanding the provisions of Sub-Section (2), the Board may co-opt any person to attend its meeting but the person so co-opted shall not have a casting vote or be counted towards quorum.
  4. The part-time Members of the Board shall be appointed by the Governor in consultation with the relevant professional bodies and shall have a tenure of 3 years each.
  5. Subject to subsection (2) of this Section, A member of the Board under subsection (2) of this section being:
    1. the holder of an elective office under the Constitution of Nigeria, shall hold office for the period he remains so elected and no more; and
    2. the Director-General of the Bureau, shall hold office on such terms and conditions as may be specified in this Law and in his letter of appointment ….
